# Terms of Service *Updated 2026-11-04. The terms for using Simpled.ai: accounts, credits and billing, your content and videos, acceptable use, connected apps such as ChatGPT, and liability. Operated by Makai Care, San Francisco.* These terms govern your use of Simpled.ai, including simpled.ai, api.simpled.ai, the Simpled.ai web application, the command-line client, and Simpled.ai inside connected apps such as ChatGPT. By creating an account or using the service you agree to them. ## Who we are Simpled.ai is operated by Makai Care, 650 California Street, San Francisco, CA 94108, US ("we", "us"). Questions about these terms go to manav@simpled.ai. ## Your account You must be at least 13 years old, and old enough to form a binding contract where you live, to use Simpled.ai. If you use it on behalf of an organisation, you confirm you are authorised to accept these terms for it. Keep your sign-in details secure. You are responsible for activity under your account, including activity by apps you connect to it. ## Credits, plans and billing Generating video uses credits. One credit equals one minute of generated video. New accounts receive a one-time allowance of free credits. Paid plans add a monthly credit allowance; monthly credits reset each billing period and do not roll over. Paid plans are billed monthly in advance through Stripe and renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period. Except where the law requires otherwise, payments are non-refundable and credits spent on a generation are not returned. If a render fails because of a fault on our side, write to us and we will restore the credits it used. We may change prices or plan allowances. Changes to a paid plan take effect from your next billing period, and we will tell you by email beforehand. ## Your content You keep all rights to the prompts, documents, logos and other material you submit ("your input"), and, as between you and us, to the videos generated for you ("your output"). You may use your output for any lawful purpose, including commercially. You grant us a limited licence to store, process and transmit your input and output only as needed to run the service for you -- for example, sending your prompt to the model providers listed in our Privacy Policy and storing the rendered video so you can download it. We do not use your content to advertise. You are responsible for your input. Only submit material you have the right to use, and do not upload personal data about other people unless you are allowed to. ## AI-generated output Videos are produced by AI models. Scripts, illustrations and narration can contain errors, simplifications or content that resembles existing material. Review every video before you publish or rely on it -- especially for medical, legal, financial or safety topics, where the output is not professional advice. Similar prompts can produce similar results for different users, so output is not guaranteed to be unique. ## Acceptable use Do not use Simpled.ai to: ### Break the law Create or distribute content that is illegal, or that infringes someone else's intellectual property, privacy or publicity rights. ### Deceive or impersonate Impersonate a real person or organisation, or make content designed to mislead people about who made it or what is true, such as fake news or fraudulent endorsements. ### Harm people Create sexual content involving minors, harassment, hate, threats, or content that promotes violence or self-harm. ### Abuse the service Probe, overload or attack our systems, get around credit limits or access controls, resell access without our agreement, or scrape the service. ## Sharing and watch links Videos are private by default. If you create a share link -- including by asking a connected app such as ChatGPT for one, or by creating a video through a connected app -- anyone with that link can watch the video without signing in. You are responsible for who you give links to. ## Connected apps and the API You can connect Simpled.ai to other apps, such as ChatGPT, or use our API and command-line client. A connected app acts on your behalf with the permissions you approve and can spend your credits when you ask it to create a video. You can disconnect it at any time. Connected apps are run by third parties under their own terms. We are not responsible for how they handle your conversations or data. API keys are personal to your account; keep them secret. ## Our service We own Simpled.ai, including its software, design and brand. These terms give you the right to use the service, not ownership of it. If you send us feedback, we may use it without obligation to you. We work to keep the service available and improve it, which means features, styles and limits can change. We will give reasonable notice before removing a feature that paid plans depend on. ## Suspension and termination You can stop using Simpled.ai and delete your account at any time. We may suspend or close an account that breaks these terms or puts the service or other users at risk; where practical, we will tell you why first. When an account is closed, its data is handled as described in our Privacy Policy. ## Disclaimers and liability The service is provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise the service will be uninterrupted or error-free. To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. Nothing in these terms limits liability that cannot be limited by law. You agree to indemnify us against third-party claims arising from your input, or from your use of the service in breach of these terms. ## Governing law These terms are governed by the laws of the State of California, excluding its conflict-of-law rules. Disputes will be heard in the state or federal courts in San Francisco County, California, unless the law where you live gives you the right to bring a claim locally. ## Changes to these terms We may update these terms. The date at the top shows the current version, and material changes are emailed to account holders before they take effect.
